Concessions

• A copy of the organisation's constitution and the minutes of the meeting that adopted it. These must both be signed and dated by the organisation's secretary.
  • If the minute of the meeting is not available, then a letter signed and dated by the organisation’s secretary will be acceptable. They should confirm that the constitution submitted is the current constitution.
  • A Council solicitor will need to be satisfied that the office bearers have the necessary authority under the organisation’s constitution.

• The full names, home addresses and contact details for the organisation’s principal officers. They should be authorised by the organisation’s constitution to sign a lease on behalf of the organisation. This is usually the chairperson, treasurer, and secretary.

We require the company name, company registration number, and the country in which the company is registered.

We require the organisation’s name and charity number.

Certain Council-owned properties are subject to title burdens, that require the approval of a third party for a lease to be granted. For example, the consent of Fields in Trust is required before the Council can grant a lease for land or buildings in certain public parks.

For Common Good properties, it may be necessary to apply to a Sheriff for approval. Public consultation is required for a disposal (including by lease) or change of use of assets held on the Common Good account.

You will receive an email with a summary of the information that you have submitted and a reference number.

We will provide you with an initial response within 20 working days of you submitting your application. If you have not received a response within this time, please email estates.enquiries@fife.gov.uk with the reference number in the subject line of your email.

If your application is approved, we will send an email with the heads of terms for a lease or licence to occupy.

If you wish to alter or add to the building and/or land, you may require the Council's consent even if no planning permission or building warrant is required. You will need to apply for a licence for works.
